In practice
Retsplejeloven (the Danish Administration of Justice Act) is the framework for the entire judicial route. The provisions that appear most often in a debt collection case are the simplified debt recovery procedure (the payment order), the rules on enforceable instruments, and the whole part of the Act dealing with enforcement in the bailiff’s court.
Where it commonly goes wrong
- Assuming the bailiff’s court can help without an enforceable instrument. The requirements for such an instrument are set out here, and they are not open to negotiation.
- You assume an invoice is enough. A claim becomes enforceable through a judgment, a payment order or a voluntary settlement — not by being undisputed.
