A claim has to survive the wait

The ability to pay comes and goes. The debtor finds work, sells something or starts a new company. Someone who could not pay three years ago may well be able to next year.

But the clock runs meanwhile. An invoice claim generally becomes time-barred after three years. With a judgment or an endorsed payment order it holds for ten. So the first step is to make the claim durable.

And someone has to keep watch the whole way. No bookkeeper has time to follow a debtor without money for five years. So the claim gets written off, and the debtor only had to be patient enough.

Most companies have realised losses going back years. Some are time-barred, some can still be collected. We go through the list and tell you which is which — including when the answer is that nothing can be done.

Monitoring picks it up when the debtor’s circumstances change
The case sits in monitoring and the debtor’s circumstances are followed. If a property, a new company or an income turns up, the claim comes back to life. You do not have to watch for it yourselves.

A claim ends up in monitoring because the credit assessment or the bailiff court showed there is nothing to take right now. It stays where the rest of the collection work sits and carries on from there.
