Formal demand fee (påkravsgebyr)
Also known as fee for formal demand, demand letter fee, gebyr for påkrav
The formal demand fee is the fee that can be added to the formal demand letter — on the same terms as a reminder fee.
Key facts
- Amount
- 100 kr.
- Legal basis
- Renteloven § 9 b
In practice
In practice the formal demand letter is also a reminder, and it can therefore carry a fee on the same terms: 100 kr. under Renteloven § 9 b (the Danish Interest Act) — and it counts towards the maximum of three fee-bearing reminders on the same claim.
The same limit applies all the way through: however many letters you send, only three of them may carry a fee.
Where it commonly goes wrong
- The formal demand fee is charged as a fourth fee on top of three reminder fees. That is not permitted.
- The demand goes out without the 10-day deadline. It is then neither a valid demand nor a fee you can charge.
- The fee is added to a letter sent before the due date. A letter sent before the claim falls due is not a reminder and carries no fee.
