Attachment of movables gives you security in the debtor's physical assets — vehicles, machinery, equipment — which can be sold at compulsory auction.
In practice
Movables are everything that can be moved: vehicles, machinery, contractors’ plant, stock, equipment. They are what an attachment against a commercial debtor most often targets.
The car is the classic. The attachment is recorded in the vehicle register (bilbogen), and the debtor can no longer sell the car free of your claim. If the car is already subject to a charge or a retention of title, those rank ahead of you — and there is often nothing left.
Where it commonly goes wrong
- Overlooking what already rests on the asset. A car with an outstanding balance owed to the finance company is rarely worth anything to an unsecured creditor.
- Going after private household effects. The exemption for necessities protects what is essential, and the rest is usually not worth an auction.
